Justice Breyer’s announcement that he will retire at the end of this term opens up a seat on the Supreme Court that will be filled with a left of center justice. Breyer, while reliably liberal in his outlook, was very thoughtful in his decisions and reassuringly calm.
President Biden has nominated Ketanji Brown Jackson, who is currently on the U.S. Court of Appeals for the D.C. Circuit. Based on how she answered questions during the Senate hearings before joining the Appeals Court, I think she will easily win approval.
It was probably a mistake for Biden to announce that he would only consider Black women for the position. Just as it was probably a mistake for him to announce that he would only consider women for the Vice Presidential position.
The New Independent Party, the predecessor organization to CIVPAC, endorsed the candidacy of Kamala Harris, as the most centrist of the plausible contenders. Justice Jackson will probably make a fine, although left of center, Supreme Court justice. (updated 3/1/22)
